Terms and Conditions

This info is a little bit dry but it’s important! We want you to know where you stand, then we know where we stand and we can stay friends.  By buying one of our products you agree to be bound by these Terms and Conditions. If you don’t agree with them please don’t place an order with us. Terms and Conditions may change from time to time so please ensure you read them regularly. You may only purchase products from the site if you are at least 18 years old. All details that you provide must correct. Whichever method of payment you choose must be your own and you must ensure that you have sufficient funds in your account to cover the payment of the order. Scroll down to the bottom of these Terms and Conditions to get to our Privacy Policy.

 

1  Definitions

 

Contract– the legally binding contract formed between you and us when you place an order for a product which we accept. We will confirm our acceptance with an e-mail. 

 

Confirmation Email – the e-mail we send to you confirming that you have placed an order.

 

Dispatch Confirmation – the email we send to you confirming your order has been dispatched.

 

Product - the products listed on the website www.honeybmuslin.com

 

Site - our website www.honeybmuslin.com

2  How to contact us

 

2.1 Our trading name is Honey Blossom Ltd. We are a very small family owned company working currently out of our home. As a result we will not publish our address on the website. If you do need to get in touch with us though for example to return a product please e-mail us at honeybmuslin@gmail.comand we will e-mail you a return address.

 

2.2 You can also get in touch via Facebook or Instagram @honeybmuslin.com or via the website www.honeybmuslin.com.

 

3  Forming a contract between us

 

By pressing ‘Place an Order’ you are offering to purchase a Product/s from us.  After the order is placed you will receive a Confirmation E-mail confirming your order. Your order will not be accepted until payment has been cleared. You will receive a Dispatch Confirmation e-mail once payment has been received in full and the order has been dispatched.

4  Copying our ideas

 

All rights including copyright are owned by Honey Blossom Ltd.  We are a small family run business please don’t take advantage of this by copying our ideas. We are always up for finding people to collaborate with so perhaps instead of copying us we could work together!

 

5  Our products and Site content

 

5.1 The pictures of our products on the Site, Facebook or Instagram my vary slightly from the Product you receive. Particularly with the hand dyed muslins. These are individually dyed, as a result each one is unique. We have made every effort to display colours correctly but we cannot guarantee the screen you are browsing on will accurately reflect the colour of the Product you choose. 

 

5.2 All products are subject to availability.  If the Product you want isn’t available we will let you know by e-mail when it will be available then you can decide if you want to continue with the purchase. 

 

5.3 We reserve the right change any content on the Site. This includes the price, description or specifications of products without any prior notice.

 

6  Availability

 

All orders are subject to acceptance and availability. If the product you have ordered is not available we will contact you via e-mail. You can then decide if you would like to wait for it to be available or you can cancel your order. If you decide to cancel your order and payment has been processed we will fully reimburse you as quickly as possible. 

 

7  Ordering errors and postage

 

You are able to check and correct errors on your order up to the point on which you click ‘Place your Order’ during the ordering process. 

 

8  Price and postage 

 

The price of the Product includes VAT and packaging. If you are ordering Products outside the UK local import taxes and duties might be applicable. International postage fees will also apply and will be added to the Product at the checkout. If international postage is not added at the checkout a separate e-mail will be sent to you to discuss postage costs which will need to be paid prior to the order being dispatched. If you decide postage will be too high but you have already paid for the Products we will fully reimburse you as soon as possible. If you return your order you will have to pay full postage for the return. We will pay full postage for a new delivery if that is the course of action being taken.

 

9  Payment terms 

 

You can pay for Products using credit, debit or Paypal account. Your order can be classed as accepted once we have taken full payment, cleared funds and a Dispatch E-mail has been sent.  We accept no liability if delivery is delayed because full payment is not received. If it is not possible to obtain full payment for the product we reserve the right to cancel the contract and or suspend further deliveries to you.

 

10  Delivery

 

10.1    All products are delivered within the UK using Royal Mail or Parcelforce. International delivery will vary. If you will not be in when the items are being delivered please be precise about where you would like the products left. We can not accept any liability for any loss or damage to the products once they have been delivered to you. If products are returned to us as undeliverable we will contact you to rearrange delivery. If we cannot contact you we will treat the order as cancelled and notify you via e-mail. We will refund the price you paid.

 

10.2    Delivery and timescale will vary depending on the product ordered and the delivery address. Estimated delivery times will vary. We are a small business, daily access to a post office isn’t always possible. We will aim to send out your order within 5 working days of receiving it. 

 

10.3    Your product is your responsibility from the time we deliver it to your address. Please check your order as soon as you receive it. 

 

11  Cancellation rights

 

11.1    If you have bought a product from us which you deem to be faulty you have a right to end the Contract and receive a refund. All of our Products undergo a very strict quality control process.  If you would like to receive a refund you will be required to pay the postage for the product to get back to us. It will then be analysed by a garment technician and you will either receive a refund or we will contact you to discuss the issue further.  If we deem that you have damaged the Product you do not have the right to a refund. 

 

11.2    Refunds - You have a legal right to change your mind about your Product within 14 days of receiving it.  If you send it back to us within this time period, and it is in the same condition that we sent it to you in, you will receive a full refund. You will have to pay the return postage fee. The amount reimbursed to you will not include the return postage fee.

 

12  Returns

 

We are really grateful for your purchase and we want you to be happy with your order! However we understand that every now and then you may wish to send something back. 

 

12.1  If you wish to return something please return it within 21 days of receipt.  At the moment because we have only just launched we can’t offer free returns. But if you send the product back with a little note explaining why you’re unhappy with it we will either give you a full refund or we will exchange it. 13  Exchanges

 

If you wish to exchange something please send it back to us with a little note about why you want to exchange it. This will need to happen within 21 days of receipt. Send an e-mail to honeybmuslin@gmail.comfor an address to send the item back to.

 

13.1  Please note:We can only exchange an item for the same item. We can’t offer an exchange of colour. Our Products have also undergone rigorous quality control, they are hand dyed so each and every one of them is individual and unique. If you have haven’t followed care instructions, so perhaps you washed your order on a very hot wash or with dark jeans we understand you might not be happy with how it comes out of the wash but it’s not faulty or our fault! Damage caused by accident, neglect, misuse, wear and tear or failure to follow care instructions will not be exchanged. When sending any Products back proof of sending is not proof of receipt by us. 

 

14  Problem with a Product

 

We want you to love your Product. If you are not completely happy with it you can e-mail honeybmuslin@gmail.comand we will get back to you within 5 working days.  Once details are known a course of action will be decided.

 

15  Your key statutory legal rights

 

The citizens advise website has information regarding your key legal statutory rights in more detail. Please visit their website for more information. 

 

15.1    You have up to 30 days from the day on which the Product is delivered to you to request a full refund if the Product is faulty.

 

15.2    Your muslin should have a long prosperous life if it is looked after well. It is reasonable to expect it to last up to 5 years. If yours doesn’t and you have followed the care guidelines please get in touch and we will repair, replace or refund.  You will have to pay for the return postage. Our textile technicians will thoroughly analyse your return. If we feel you haven’t looked after your Product we will contact you and a course of action will be decided.

 

15.3    If we are required by law to refund to you the price you paid for your Product we will within 14 days of the decision being made to refund you. A refund will be issued via the same means you paid for the Product where possible.

16  Warranty

 

Your Product should be free from any material defects for 12 months from delivery. If damage is caused through unreasonable wear and tear this warranty does not apply. Care instructions must be followed at all times. If you wish to send Products back to us because you think they breach the warranty please e-mail us at honeybmuslin@gmail.comand we will send a return address. You will have to pay for return postage. Please include a name, address and why you think your muslin Product breaches our warranty. A garment technician will then examine the Product and a decision will be made as to whether the product does have a material defect. You will then be offered a refund for the amount you paid or a replacement. If it is decided that the Product does not breach our warranty we will invite you to collect your muslin or pay for postage for us to send it back to you. When sending any products back proof of sending is not proof of receipt by us. 

 

17  Our responsibility for loss and damage suffered by you 

 

We only supply products for domestic and private use. If you use the Product for any commercial, business or re-sale purposes we have no liability to you for any loss of profit or loss of business.

 

18  Certification

 

The organic component of our Products meet the Global Organic Textile Standard (GOTS). All textiles are also Oeko-Tex Standard 100 Product class 1. This means they are completely safe to be in direct contact with a baby’s skin. Our Products are all sourced from a Fair Trade supplier who are also SA 8000 certified. This is the highest international level of social accountability. Workers are well looked after; sanitation, worker safety, fair wages, clean water, ventilation, CCTV and of course there is no child labour. These are wholesome good products. We hope you love them.

 

19  Use of our Products

 

This is common sense but we thought we’d mention it. Your Product has been made for using. However we also want you to be careful when using it. Muslin material is naturally breathable but it is still important to never cover a baby’s head. If you are using one of our large muslins as a blanket be aware that babies get hot very quickly, always keep a close eye on your baby, they aren’t very good at regulating their heat until they are a little bit older.

 

20  Charitable donation

 

5% of yearly profits will be given to a charity of our choosing. All charities supported will be decided by a vote put to our consumers. Themes include; parent and baby charities, children charities and environmental charities. Any suggestions are welcome.

 

21  How we may use your personal information

 

21.1    We will use the personal information you provide us with to; provide the products to you, to process your payments for the products and to inform you about products or services that we provide. If you do not want to receive ongoing contact please contact us and we will take you off our books. 

 

21.2    We will not give your personal data to any third party.

 

22  Our right to not accept orders

 

We may decide to not accept an order from you for products. If we do so, and you have made an advance payment for the product we will contact you and refund you the full amount as soon as possible.

 

23  Changes to our Terms and Conditions

 

We may update or amend these Terms and Conditions every now and then. By you using our site you agree to these Terms and Conditions. Please therefore review them regularly to ensure you are aware of any changes which have been made. 

 

24  Events outside of our control

 

We are not responsible for an Event Outside of our Control. An Event Outside of our Control means any act or event beyond our reasonable control. This includes but is not limited to; invasion, terrorist activity, fire, explosions, natural disaster, epidemic, failure of our suppliers and failure of the postage system. 

 

24.1  If an Event Outside of our Control occurs we will contact you as soon as reasonably possible. Our obligation under these Terms and Conditions will be suspended until the Event Outside of Our Control is over.

 

25  Agreement

 

These Terms and Conditions are the up to date version of our agreement with our customer. Nothing in these Terms and Conditions shall exclude or limit our liability for something that we cannot exclude or limit in law.

 

26  Invalidity

 

Each of the paragraphs in these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force. 

 

27  Third party rights

 

This contract is between you and us. No one else has any rights to enforce any of its terms.

 

28  Law, jurisdiction, language and privacy

 

These Terms and Conditions are governed by English Law. Legal proceedings in respect of the products must be brought to English Court. They are written in English. There is currently no other official translation. 

 

28.1  We have a separate privacy policy. By using our website you agree to our privacy policy. To read it scroll to the bottom of these Terms and Conditions and you will find it. 

 

29  Data Protection

 

Honey Blossom Ltd was incorporated in Jan 2018. Once it starts trading it will endeavor to become a registered processor under the Data Protection Act. Until that is official we make a promise to you to never pass on your details to third parties for marketing purposes unless you specifically agree for us to do so (for example you enter a prize draw or competition where it is set out in the terms of promotion). By purchasing goods from us you agree to our Terms and Conditions and to receive email marketing from us in the future. You can opt out of marketing by contacting us at honeybmuslin@gmail.com

 

29.1  We will only share your data with others for example agents, credit card reference agencies, credit/debt clearing agency and fraud prevention and detection agencies if it is absolutely necessary. We work hard to take all reasonable steps to protect your personal information. We cannot guarantee the security of any data that you disclose online and will not be responsible for any breach of security unless this is due to our negligence.
